INTERPRETATION
In this agreement
“Membership Card”
means a discount card and/or discount vouchers obtained, directly or indirectly, from International Desi;
“Partners”
means a restaurant, store or other provider of goods and/or services who is registered to accept a Discount Card or gift voucher;
“Gift vouchers”
means the various vouchers provided by participating retailers gifting either specific items e.g. meal, beauty treatment or with a monetary value
“International Desi Member resident of Hong Kong”
means anyone who holds valid membership card issued by International Desi, an organization registered in Hong Kong.
“You” or “you”
means a recipient of a Discount Card or gift voucher (who shall be a person recognized as a member of Hong Kong Desi Discount Club through the application process).

1.2 The terms and conditions set out below apply to the provision to you by International Desi of the Discount Card and gift vouchers and the use by you of your Discount Card and gift vouchers.

1.4. Once you have received your Discount Card you signify your agreement to be bound by these terms and conditions by using your Discount Card.
1.5. By using a gift voucher at a participating retailer you signify you agreement to be bound by these terms and conditions for the use of gift vouchers.
1.6. The Discount Card and gift vouchers are supplied to you on the basis of the information supplied to us by, or on behalf of, you in your Application Form. International Desi reserves the right to immediately and without notice cancel your Discount Card and gift vouchers at its absolute discretion for any reason whatsoever including, inter alia, if any information supplied to International Desi by you is incorrect or misleading.
1.7. International Desi has no relationship with the organization for which you shop and provides the scheme separately from them through independent negotiations with local businesses.
1.8. If you are contributing for any cause by buying vouchers or gift cards to needy people, we recommend you send us separate email.
1.9. International Desi reserves the right to amend these terms and conditions at any time by publishing a notice on its website to that effect.

2. Expiry date and delivery of the discount card
2.1. The Discount Card will be valid for a year from the date of issuance and the expiry date will be printed on the front of the Discount Card.
2.2. International Desi will aim to send your personalized Discount Card to you by post within 14 days of receiving your application.

3. Using your discount card at participating restaurants and stores.
3.1. International Desi will use reasonable endeavors to maintain a list of those business participating in the discount scheme on the Hong Kong Desi official platforms until the said business notifies International Desi that it is cancelling the agreement; International Desi cancels the agreement, or said business is no longer in operation.

3.2. Subject to these terms and conditions, on presentation of your Discount Card, participating Retailers will offer minimum 10% (or more %) off on your total purchase amount of personal purchases depending on their policy at that time, as the case may be.
Retailers reserve the right to refuse the Discount Card and the application of any discount for some or all of their goods and/or services at their absolute discretion.
3.3. Please check the terms and conditions of the particular offer you are interested in before making a purchase.
3.4. Where a Retailer requires you to pre-book (e.g. hairdresser, restaurant) you should state at the time of booking that you intend to use the Discount Card.
3.5. At a Retailer where you pay for goods after use (e.g. hairdresser, restaurant), with or without pre-booking, you should inform the Retailer that you intend to use the Discount card prior to the receipt of relevant goods/services
3.6. In all other circumstances you must inform the Retailer that you have a Discount Card immediately prior to the point of purchase (e.g. at the till).
3.7. You are not required to make an associated purchase or minimum spend when using the Discount Card.
3.8. The use of your Discount Card may not be available in conjunction with any other offers participating Retailers might be running.
3.9. The expiry date of your Discount card will be checked by participating Retailers when you redeem the offer. Expired Discount Cards will not be accepted.
3.10. Your Discount Card is strictly non-transferable and so cannot be used by either friends or family members or other third parties. Participating Retailers may ask you to show photo identification such as a driving license or HKID to confirm that you are the Discount Card holder or are permitted by law to make any acquisition. Any attempted misuse of the Discount Card will result in cancellation of the card.
3.11. Participating Retailers are entitled to withdraw their offer or change the terms and conditions of their offer from time to time. International Desi shall have no liability for any such withdrawals or changes in their terms and conditions.

4. Choosing and collecting a gift voucher
4.1. When you are supplied with a Discount Card (and on other occasions as deemed appropriate by International Desi) you will also be supplied with a unique gift voucher code that can be redeemed in exchange for a gift voucher provided by a participating retailer.
4.2. The available gifts will be displayed on our website (Hong Kong Desi's Discount page - list of partners) and once chosen and the gift voucher code entered the relevant gift voucher will be provided for you to print and use.
4.3. When redeeming your gift voucher code you will be required to enter your name which will also be displayed on the gift voucher which is strictly non-transferable and so cannot be used by either friends or family members or other third parties. Participating Retailers may ask you to show photo identification such as a driving license or passport to confirm that you are the rightful owner of the gift voucher or are permitted by law to make any acquisition. Any attempted misuse of a gift voucher will result in cancellation of the voucher.
4.4. The gift vouchers may only be redeemed before the expiry date displayed on the gift voucher (usually by the end of the month of collection) and when expired cannot be exchanged for an in date voucher.

5.9. Participating Retailers are entitled to withdraw their offer or change the terms and conditions of their offer from time to time. International Desi shall have no liability for any such withdrawals or changes in their terms and conditions.

6. Liability
6.1. International Desi will not be responsible for any indirect losses, consequential, exemplary, special or punitive damages, lost opportunities, loss of profits, anticipated profits, actual or anticipated savings.
6.2. International Desi does not limit its liability at law for fraudulent misrepresentation or for death or personal injury caused by negligence or any other type of liability which cannot by law be excluded or limited.
6.3. Where you make a purchase using your Discount Card or use a gift voucher from any participating Retailer, any losses or liability arising out of or in connection with such purchases shall be the relevant participating Retailer’s liability. International Desi does not accept liability for unsatisfactory experiences or any failure by the participating Retailers to deliver expected goods or services or the quality thereof.
6.4. International Desi will not be under any obligation to become involved in any dispute between you and any participating Retailer. Any complaints (including but not limited to the products or services or quality etc.) should be taken up with the participating Retailer.
6.5. International Desi does not give any warranty for any goods or services purchased with use of the Discount Card.

8. Severability
8.1. If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

9. Third party rights
9.1. A person who is not party to these terms and conditions shall have no rights under or in connection with it under The Contracts (Rights of Third Parties) Ordinance (Cap 623).

10. Entire Agreement
10.1. These terms and conditions constitute the whole agreement between us and supersede all previous discussion, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions.

Each of the parties agrees that it has not entered into these terms and conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these terms and conditions or not) other than as expressly set out in these terms and conditions.

11. Law and jurisdiction
11.1. This agreement shall be interpreted in accordance with Hong Kong law and will be subject to the non-exclusive jurisdiction of the Hong Kong Courts.
